This Refund Policy ("Policy") governs the terms under which refunds may be requested from Hedgetide Limited ("the/our Company," "we," "us," or "our"). By purchasing or subscribing to any product or service offered by our Company and the digital content, proprietary methodology, applications and platforms where applicable, methodological programs or modules, proprietary data ("Proprietary Data"), information materials, course or courses, webinars, presentations, electronic mail content, and analytical resources provided by our Company (collectively, the "Services"), you ("Client," "you," or "your") agree to the terms set forth below.
1. General Policy
Our Programs or Modules are designed to deliver proprietary methodology accessible to Clients in multiple countries. Because our Services may include digital content, presentations, and downloadable materials, refund eligibility varies based on the type of product or service purchased.
We reserve the right to update, modify, or revise this Policy at any time. Changes become effective upon publication on our website.
2. Methodological Programs or Modules
All purchases of digital content, presentations, proprietary methodology, downloadable materials, methodological programs or modules, and analytical resources, or on-line Services, and subscriptions thereto shall be deemed final on an "as-is" and "as-available" basis once access has been granted, as specified in our Terms and Conditions, Disclaimer, and Proprietary Data Disclaimer.
Notwithstanding the above, the Company may offer a refund within 14 calendar days of purchase or subscription, inclusive of any free-of-charge trial periods, if all of the following conditions are met to the extent applicable:
You provide a written request via our client electronic mail address;
You have attended, actively participated in, and sustained consistent attention and focus during all the proprietary methodology sessions or meetings prior to the above-mentioned written request regardless of the schedules of those sessions or meetings;
You present the reason or reasons for dissatisfaction, so that we may improve the Services, provided that we are under no obligation to improve the Services;
You have not used a Trial Period for the purchase or subscription you are requesting a refund for;
You have opted out of escrowing your subscription fee or you have not opted for escrowing it by the time of requesting a refund for the Institutional Module, if applicable;
You have not had access to the Proprietary Data.
If the above conditions are not fully met to the extent applicable, your purchase or subscription shall remain non-refundable.
In case a refund is granted as per the foregoing, the value of any Promotional, Coupon, Discount, or Redemption Codes redeemed shall be deducted from the refund.
3. Subscription Services
If you purchase a subscription-based product or service, you may cancel at any time. Your cancellation prevents future charges. Any refund for a subscription-based product or service falls under the terms specified in the previous Section of this Policy in its entirety.
4. International Clients
Refunds are processed in the original payment currency. Currency conversion costs, international banking fees, and transaction-processing charges are non-refundable.
Some countries may grant additional consumer rights, applicable if you use the Services as an individual consumer wholly or mainly for personal, family, or household purposes and outside your trade, business, craft, or profession, and we comply where legally required.
5. Unauthorized Purchases and Billing Errors
If you believe a charge was made in error or without authorization, you must contact us within 10 calendar days of the transaction. We will investigate and respond in accordance with applicable regulations.
6. How to Request a Refund
To initiate a refund request, you must contact us via our client electronic mail address.
You must include your full name, order number where available, payment method, and the reason or reasons for your request.
7. Non-refundable Items
The following are strictly non-refundable unless otherwise required by law:
Completed or expired methodological programs or modules;
Terminated subscriptions;
Third party products or services, including without limitation products or services offered by our Company's partners;
Data-feed fees;
Escrowed products or services - applicable to the Institutional Module.
Non-refundable items which are part of the refund shall be deducted from the refund.
8. Compliance and Exceptions
Our Company respects the legal requirements of each jurisdiction, which our Company operates in or has clients in. If local regulations grant additional refund rights beyond this Refund Policy, our Company will comply with applicable law.
9. Amendments to This Refund Policy
We may update, amend, revise, or make changes to this Refund Policy periodically. Updates will be uploaded with a revised "Last Updated" date. Continued use of the Services constitutes acceptance of the updated terms.
